Motorcycle lawyers from Michigan Auto Law are raising awareness of the deadly consequences of motorcycle helmet law repeal efforts underway throughout the country by asking drivers to watch the following “animoto.”
“We hope this animoto illustrates the ridiculousness and lack of common sense behind campaigns to repeal state motorcycle helmet law requirements,” said Steven M. Gursten, motorcycle lawyer and head of Farmington Hills-based Michigan Auto Law. “Who knows, maybe seat belts are next?”
Gursten said repealing state motorcycle helmet laws is a dangerous and deadly mistake for two serious reasons: “First, there will be a drastic hike in motorcycle accident deaths and serious personal injuries,” he said. “Second, because of the immense medical costs that result from such crashes, injured motorcycle operators will be pushed onto Medicaid, leaving taxpayers responsible to foot the bill for millions in lifetime healthcare costs.”
Gursten has been interviewed by local and national media on motorcycle helmet law repeal efforts and is available for comment.
In Michigan, there is proposed legislation pending, such as SB 291, which would allow Michigan motorcyclists who are at least 21 years old to ride without a motorcycle helmet. The bill also requires motorcyclists to purchase only $ 20,000 in No-Fault motorcycle PIP insurance coverage – an amount that is woefully inadequate and will be exhausted in a weekend after a serious injury from a motorcycle accident, Gursten noted.
“For catastrophic personal injuries, like traumatic brain injuries (TBI) and spinal cord injuries (SCI) $ 20,000 in motorcycle PIP insurance for medical coverage can be exhausted in the first day alone in a hospital. And after that, the entire lifetime expense is shifted to Medicaid and to the taxpayers,” Gursten added. “This makes absolutely no sense.”
Currently, Michigan is one of several states with pending motorcycle helmet law repeal efforts underway.
